    1. Steinar Grøtterød Please note that Ken Herman sent out a post on the NCSG Mailing List. Since this list operates on a non-ICANN server, I am opting to comment for the next CPWG Call on 24 April 2024.

      The Crunch Point: Calibration of the Number of Days of "Lock - In"

      The 60-day lock is automatically added to domains upon creation. The domain settings can be managed and only transferring to another registrar is prevented during the 60-day Lock.

      I am taking the liberty of including below some related aspects.

      1. The average time take for a domain transfer is 5 - 7 days.
      2. Registrar Specified Policies: 1 - 2 Days
      3. Domain Unlocking: 1 Day
      4. Domains Close to Expiration may need a varying time specified by the Registrar.
      5. Verification Process including validation of the EPP Code: 1-2 Days 
      6. Domain Extension (TLD) Requirements:  Varying Time
      7. Transfer Approval and DNS Propagation: 1-3 days

      The ICANN 60 day lock does not prevent the domain from functioning or being accessible. If the website is already set up, online visitors will be able to access it. This lock-in is solely a protective measure related to domain transfers, registrations, or changes in contact information. During the lock-in the website and its associated services will remain operational.

      PS: The paradox found in Internet governance is that the network is intrinsically “global” but its governance does not correspond to this idea. ICANN's multi-stakeholder model is a nice method with technology basis.

      The GNSO-TPR working group focused on the recommendation 17 connected to post-transfer lock. The present transfer policy define a post-transfer lock as optional. The majority of the GNSO-TPR working group have consensus to make a post-transfer lock mandatory but enable registrars to lift the lock under certain conditions and requirements.

      Present policy text

      The Registrar of Record MAY deny a transfer request only in the following specific instances: A domain name is within 60 days (or a lesser period to be determined) after being transferred (apart from being transferred back to the original Registrar in cases where both Registrars so agree and/or where a decision in the dispute resolution process so directs). "Transferred" shall only mean that an inter-registrar transfer has occurred in accordance with the procedures of this policy.

      A) The Registrar MUST restrict the Registered Name Holder from transferring a domain name to a new Registrar within 30 days / 720 hours of the completion of an inter-Registrar transfer. To the extent that a Registry and/or Registrar has an existing policy and/or practice of restricting the RNH from transferring a domain name to a new Registrar for a different period of time following an inter-Registrar transfer, all policies and practices MUST be updated to be consistent with this new requirement.

      B) However, the working group recognizes that there may be exceptional situations where early removal of the 30-day restriction described in Rec. 17(a) is necessary. Accordingly, the Registrar MAY remove the 30-day inter-registrar transfer restriction early only if all of the below conditions are met: 

      1. The Registrar MUST be able to demonstrate that it received a specific request to remove the 30-day restriction from the Registered Name Holder, and
      2. The Registrar MUST ensure the request to remove the restriction was requested by the Registered Name Holder;
      3. The request from the Registered Name Holder to remove the restriction MUST be providedsent via a secure mechanism;
      4. The Registrar MUST manually confirm that the specific request includes a reasonable basis legitimate rationale foras to why removal of the restriction is necessary. [Examples of legitimate rationales include but are not limited to...[WG to insert];
      5. The Registrar MUST maintain a record demonstrating the request to remove the restriction (regardless of outcome) for a period of no fewer than fifteen (15) months following the end of the Registrar’s sponsorship of the registration. 

      In particular, the criteria for lifting the post-transfer lock (Rec. 17B) created discussion.

      I am in favor of Rec 17A and 17B but the text for 17B must be "clear".

      The next step for the GNSO-TPR working group will be discussion transfer locks due the changes of registration data (CORD).
