Introduction
The issue of vertical separation/integration of registrars and registries is being discussed as part of the draft implementation model for new gTLDs (see Version 3 of the Draft Registry Agreement of the Draft Applicant Guidebook for New gTLDs). The discussion on vertical integration/separation of registrars/registries focuses on two basic issues:
- Full/Partial Ownership: Should registries be allowed to own a registrars and vice versa, should registrars be able to own a registries? Should registries be allowed to have affiliates which would result in partial ownership of registrars and vice versa?
- Ownership Restrictions: Should there be contractual provisions that apply when a registry is owned by a registrar and vice versa?
