Request for Proposal: Study About the Domain Name System (DNS) Industry and Business in Africa

The Internet Corporation for Assigned Names and Numbers (ICANN) is seeking a provider to conduct a study on the domain name industry in Africa.

The goal of this study is to identify and define the strengths and weaknesses in the industry ecosystem within the region and develop recommendations on how to advance the industry and bring it closer to the opportunities available.

The ICANN's Africa Strategic Plan, reviewed in 2014, defined four key areas of interest as strategic focus for the region. Two of those, namely Capacity Building and Outreach and Economic Concerns consider the different areas and opportunities available to further develop the domain name industry in Africa.

The study at a minimum will:

  • Investigate the current state of the Internet and the domain name industry in the region
  • Define best practices that have made an impact in domain name market growth
  • Look at the broader ecosystem of the Internet infrastructure and online services and describe the impact of such elements on the overall evolution of the domain name industry
  • Describe the business potential in the domain name industry in Africa, and
  • Provide suggestions on how to develop the industry and what business models can be adopted in the entire industry chain.

The study will include data, analysis, and recommendations.

The final report of the study is to be delivered no later than 30th April 2016. An intermediary report should be provided in March 2015

Notice of Preliminary Determination To Grant Registrar Data Retention Waiver Request for Realtime Register B.V.

ICANN has made a preliminary determination that it is prepared to grant a data retention waiver request submitted by Registrar Realtime Register B.V. under the 2013 Registrar Accreditation Agreement (the "2013 RAA"). Section 2 of the Data Retention Specification (the "Specification") of 2013 RAA provides that prior to granting any exemption under the Specification, ICANN will post its determination on the ICANN website for a period of thirty (30) calendar days.

Pursuant to Section 2 of the Specification, Realtime Register B.V. submitted to ICANN a Registrar Data Retention Waiver Request ("Waiver Request") on the basis of Realtime Register B.V.'s contention that compliance with the data collection and/or retention requirements of the Specification violates applicable law in the Netherlands.

The Waiver Request was accompanied by a written legal opinion from a nationally recognized law firm dated 19 December 2013 and a supplementing opinion dated 21 August 2015 citing Articles 7, 10 and 11 of the Rules for the protection of personal data (Personal Data Protection Act) (Wet bescherming persoonsgegevens) (the “PDPA”). These Articles provide as follows (the following is an unofficial English translation from Dutch):

Article 7:

Personal data shall be collected for specific, explicitly defined and legitimate purposes.

 

Article 10 (1):

Personal data shall not be kept in a form which allows the data subject to be identified for any longer than is necessary for achieving the purposes for which they were collected or subsequently processed.

 

Article 11 (1):

Personal data shall only be processed where, given the purposes for which they are collected or subsequently processed, they are adequate, relevant and not excessive.

Following receipt of the Waiver Request, and in accordance with the 2013 RAA, ICANN through its legal counsel and Realtime Register B.V. discussed the matter in good faith in an effort to reach a mutually acceptable resolution of the matter.

The outcome of those discussions is that Realtime Register B.V. is seeking a waiver with respect to the following data elements: log files as referred to in Sections 1.2.2 and 1.2.3 of the Specification as well as telephone numbers, source IP addresses and HTTP headers as referred to in Section 1.2.2 of the Specification. The waiver seeks to exclude these data elements from the obligation stated in Section 1.2 of the Specification according to which such data elements must be retained for no less than one hundred and eighty (180) days following the relevant interaction.

ICANN has determined on a preliminary basis that it is prepared to grant the data retention waiver request. ICANN is posting this preliminary determination for a period of thirty (30) days to seek feedback and input from the community on the proposed data retention waiver. After the thirty (30) day period following this posting has expired, ICANN will consider all feedback and input received before making a final determination on whether to grant the Waiver Request.

The scope of the proposed waiver would be to permit Realtime Register B.V. to exclude log files as referred to in Sections 1.2.2 and 1.2.3 of the Specification as well as telephone numbers, source IP addresses and HTTP headers as referred to in Section 1.2.2 of the Specification from the obligation to retain such information for no less than one hundred and eighty (180) days following the relevant interaction. In all other respects the terms of the Specification would remain AS-IS.

The specific change to the Specification would be that, for the duration of the Waiver, the retention requirement of Sections 1.2.2 and 1.2.3 of the Specification would not be applicable to log files and the retention requirement of Section 1.2.2 would not be applicable to telephone numbers, source IP addresses and HTTP headers.

With respect to HTTP headers as referred to in Section 1.2.2 of the Specification, the following exception to the waiver applies: In each instance for which the communication with the Registrant is carried out browser-based (and not via email), Realtime Register B.V. may decide, but is not obliged, to store HTTP requests and responses in order to ensure proof of communication with the Registrant. If HTPP requests and responses are stored in such case, Realtime Register B.V.’s obligations arising from the Specification (as well as any other obligations arising of the 2013 RAA) shall be fully applicable with respect to such information.

With respect to log files as referred to in Sections 1.2.2 and 1.2.3 of the Specification, the following exception to the waiver applies: Date and time stamp information will be stored by Realtime Register B.V. and thus Realtime Register B.V.’s obligations arising from the Specification (as well as any other obligations arising of the 2013 RAA) shall be fully applicable with respect to such information.

If ICANN does make a final determination to grant the Waiver Request sought by Realtime Register B.V., the provisions of Section 3 of the Specification would apply to similar waivers requested by other registrars located in the Netherlands and subject to the laws of the Netherlands. Section 3 of the Specification provides as follows:

If (i) ICANN has previously waived compliance with the requirements of any requirement of this Data Retention Specification in response to a Waiver Request from a registrar that is located in the same jurisdiction as Registrar and (ii) Registrar is subject to the same applicable law that gave rise to ICANN's agreement to grant such wavier, Registrar may request that ICANN to grant a similar waiver, which request shall be approved by ICANN, unless ICANN provides Registrar with a reasonable justification for not approving such request, in which case Registrar may thereafter make an Wavier Request pursuant to Section 2 of this Data Retention Specification.

A public comment period will remain open until 23:59 UTC, 30 December 2015. Public comments will be available for consideration by ICANN staff and the ICANN Board.

Portal Data Exposure Investigation Concluded

The Internet Corporation for Assigned Names and Numbers (ICANN) has concluded its investigation into a data exposure issue in the New gTLD Applicant and Global Domains Division (GDD) portals, first announced on 1 March 2015. These portals contain information from New gTLD program applicants and New gTLD registry operators.

As described in the 30 April 2015 update, an investigation supported by two IT consulting firms was launched by ICANN in March 2015 to review and analyze all log data since the activation of the portals. The latest update on 27 May 2015 detailed the findings regarding the nature of the disclosures. Since then, ICANN continued to investigate this matter and found that, in addition to the previous disclosures, 12 user credentials were used to access contact information from eight registry operators. Based on the information collected during the investigation it appears that contact information for registry operators was accessed inadvertently. ICANN also concluded that the exposed registry contact information does not appear to contain sensitive personally identifiable information. Each of the affected parties has been notified of the data exposure.

The investigation is now complete. ICANN has taken the necessary steps to determine how the data exposures occurred and confirmed that the exposure issues resulted from several misconfigurations in the portals. These misconfigurations have been addressed to prevent these types of disclosures in the future. ICANN has also confirmed that no other ICANN systems were affected. ICANN continues to deploy security-based updates on a regular basis as part of a broader, multiyear effort to harden all of ICANN's digital services.

Results Available for 18 November 2015 New gTLD Program Auction

On 18 November 2015, Power Auctions LLC, ICANN's authorized auction service provider, conducted a New gTLD Program Auction to resolve string contention for one new generic top-level domain (gTLD) contention set: .HOTELS/.HOTEIS. The applicants were unable to resolve contention among themselves; thus their contention set proceeded to auction, which is the method of last resort to resolve string contention as prescribed in Module 4 of the New gTLD Program Applicant Guidebook. Subject to payment of the winning price and meeting all other criteria for eligibility, the winner will enter ICANN's contracting process to sign a Registry Agreement to operate the gTLD.

Two applicants participated in the auction for .HOTELS/.HOTEIS. Booking.com B.V., applicant for .HOTELS, prevailed with a winning price of $2,200,000.

All proceeds from the Auction are being segregated and withheld from use until ICANN's Board of Directors define a plan for an appropriate use of the funds through consultation with the community.

ICANN Announces Conclusion of 2013 Registrar Accreditation Agreement Whois Accuracy Program Specification Review

ICANN announces the completion of the first formal review of the 2013 Registrar Accreditation Agreement's Whois Accuracy Program Specification ("Specification").

The Specification includes requirements for ICANN-accredited registrars to validate and verify certain Whois data and customer account holder information and calls for a review of its terms by ICANN and the Registrar Stakeholder Group (RrSG).

ICANN and the Registrar Stakeholder Group each proposed a handful of topics as candidates for possible updates. A summary of these topics was posted for public comment in May 2015. Twenty-two comments were received from community members.

In light of the public comments received and negotiations between ICANN and the RrSG, ICANN and the RrSG have reached agreement that no amendments should be made to the Specification at this time. Instead, the Specification will be subject to an additional review in approximately one year. This future review will have the added benefit of being informed by the data compiled via the Whois Accuracy Reporting System initiative.

A clarifying advisory has been posted to ICANN's website.

ICANN and the RrSG wish to thank the many community members who contributed comments in furtherance of this review.

Candidates for Competition, Consumer Trust and Choice Review Team Announced

ICANN today announced 71 individuals applied to serve on the team that will review the New gTLD Program in relation to competition, consumer trust and consumer choice (CCT). Candidates hail from Bahrain, China, Kenya, Jamaica, Spain and many other countries. Their collective professional experience spans a variety of industries. Some are part of ICANN supporting organizations and advisory committees, while others volunteered as independent experts. The review is mandated by ICANN's Affirmation of Commitments.

Next Steps

The list of applicants and documentation provided in their applications has been published at: https://www.icann.org/resources/reviews/aoc/cct/applications. Supporting organizations and advisory committees have until 14 December 2015 to review these materials and determine whether they would like to endorse certain candidates as representatives of their respective constituencies.

The composition of the CCT review team will be determined by ICANN's CEO and the chair of the Governmental Advisory Committee, as described in the call for volunteers. ICANN will provide the CEO and chair with the list of candidates, supporting documentation and endorsements. Expertise, geographic location and endorsements will all be taken into consideration when selecting the team.

ICANN's FY16 Objective, Goal and Portfolio Shepherds

Recent comments from the ICANN community suggest providing a consolidated view of the already published information on Shepherds to bring greater visibility into which executives are responsible for collecting and communicating cross-functional performance relevant to work at ICANN.

The Project Portfolio Management System is intended to provide visibility into ICANN's annual work and is guided by the Strategic Plan [PDF, 1.65 MB] and Five-Year Operating Plan [PDF, 1.01 MB], which were developed by the community with staff, and organized in a hierarchy of Objectives, Goals, Portfolios, and Projects. As stated in ICANN's 31 Jul 2015 blog, "the Project Portfolio Management System structure "is not an organization chart and was never intended to outline or reflect reporting structures or budget oversight responsibilities. It describes broad cross-functional goals and objectives, not reporting structures or budgets. Virtually every objective and goal in ICANN's Strategic Plan and in the Project Portfolio Management System is cross-functional and involves multiple departments within the organization."

The Project Portfolio Management System structure was designed to be one that evolves over time, is adapted to fit new circumstances and is periodically changed as part of ongoing process improvement. As such, ICANN is publishing a list to reflect the current structure of Objectives, Goals, Portfolios and Shepherds rather than the structure found in the Adopted FY16 Operating Plan and Budget. The list for now can be found in the document titled: List of Objectives, Goals, Portfolios and Shepherds [PDF, 224 KB].

Going forward, ICANN will publish Shepherds in the annual Operating Plan and Budgets.

As a reminder, updates on ICANN's Project Portfolio Management System can be found at myicann.org. This is just one of ICANN's performance reporting mechanisms amongst others, including the Quarterly Stakeholder Calls, the KPI Beta Dashboard, and the Quarterly Financial Statements.

The beta site testing period will continue through the end of 2015. Your feedback is key to the success of the official new At-Large website. During this period, please use the beta site often and test its various features and functions, such as the ALAC advice search, policy topic pages, Google Calendar, and RALO/ALS pages. We are eager to hear about your user experience. To provide your feedback, you can:

To prepare for the launch of the official website, a few more new pages will be built out. The team will also conduct final testing with regard to the site's mobile responsiveness and accessibility features, as well as finish the content migration and static content translations. The official site will be launched in January 2016.
