Applicable Rules for Votes in LACRALO

LACRALO Operating Principles.  Updated in March 4, 2009 by the LACRALO General Assembly held during the ICANN meeting in Mexico

• Article 8. The LACRALO shall elect two (2) individual to serve as representatives before the At Large Advisory Committee (ALAC) on the terms specified in the ICANN By-Laws. Only those ALSs that have beenaccredited prior to the election shall be entitled to vote in the election.

Each accredited ALS shall be entitled to one vote. The selected representatives shall be members of various ALSs, have their main places of residence in countries of the region, and their nationalities must be distinct. The representatives shall be responsible for the duties stipulated by the ICANN By-Laws.
In the case of the election, the affiliation, residency and nationality shall also be taken into account with respect to the person acting as a representative vis-Ã -vis the ALAC on behalf of the LAC appointed by the NOMCOM.

ORDINARY RULES OF PROCEDURE FOR MEETINGS OF DELIBERATIVE BODIES OF THE COMMUNITY

• Rule 12 - Voting 
  12.9 The number of votes cast for or against any motion shall be limited by the following calculation with respect to any Assembly that is international in nature:
  a) The number of countries or territories covered by the entire membership of the Assembly shall form the numerator.
  b) The denominator shall be 100.
  c) The result of the division of (a)/ (b) shall be multiplied by 100.
  d) The result of 12.9(c) shall be known as the Maximum Percentage.
  e) The votes cast by delegates representing ALSes normally domiciled in any one
  Country may not in the aggregate exceed the Maximum Percentage. This calculation shall be separately applied to votes for and against any motion.

• According to Article 12.2 of the Rules of Procedures and “according with that  established in Rules 6.2  the resolutions will be decided by the majority of ALS present and voting; for purposes of these rules, the sentence “ ALS present and voting” refers to the ALS issuing a negative or positive vote. ALS abstaining, will be considered as not having voted”.

The quorum to take into account, according to Rule 6.1 “ The quorum will be  a simple majority of ALSes accredited referred to in Rule 1.1 present and represented at  the Assembly”

• Rule 6 - Quorum

6.1 A quorum shall consist of a simple majority of the accredited ALS referred to in Rule 1.1 present and represented at the Assembly.

6.2 The Assembly shall not decide on any matter unless a quorum is present  

 

Procedure in the case of a TIE (en caso que dicha situacion ocurra)

The decision will be made by a draw. A draw means the decision will be made by random selection.

Rules:

Absent provisions re ties in the two LACRALO regulations available, LACRALO  doc AL/2007/SD/2.Rev2, specifically provides  “the  full Rules of Procedure of the UN General Assembly may be invoked by participants of any meeting, or the Chair of any meeting, which is using these Ordinary Rules, as needed, to allow complex situations or difficult negotiations to be facilitated in a rules-based framework” . This rule is based on the UN GA Rule 132 (93) quoted below.

• UN GA Rule 132 [93] When only one person or Member is to be elected and no candidate obtains in the first ballot the majority required, a second ballot shall be taken, which shall be restricted to the two candidates obtaining the largest
  number of votes. If in the second ballot the votes are equally divided, and a majority is required, the Chairman shall decide between the candidates by drawing lots.

  

Rules for ONE single candidate (in case such situation occurs)

"In the case of a nomination of one candidate, LACRALO community will hold a poll. If a majority (more than 50%) of people responding to the poll, NOT counting abstentions, indicates NO, then the selection process for the ALAC seat will be restarted with a new call for nominations. On the contrary, the candidate will be nominated."

Abstentions:

According to rule 12.2, At Large Structures abstaining from voting shall be regarded as having not voted. However rule 19 says  - When a Virtual Meeting of the Assembly is held, the following Rules shall not apply:6, 12.3. So those casting a vote “abstain” are counted for purposes of reaching quorum.  Based on past votes, staff has identified  that abstention will be counted toward quorum, but abstention will not be counted toward result interpretation; in other words, for result interpretation, we will only count the votes casted for candidate(s), and the candidate(s) with the most votes win.

For releasing results, and in the case of elections for Chair and Secretariat, past practice shall be followed.

Principios Operativos de LACRALO .  Actualizados el 4 de Marzo, 2009 en la Asamblea General de LACRALO que se llevó a cabo en la reunión de ICANN de México.

• Articulo 8. LACRALO elegirá dos (2) individuos para servir  como representantes ante el Comité Asesor de ALAC de (ALAC) en los términos especificados en los Estatutos de ICANN. Solo aquellas ALSs que se han acreditado antes de la elección estarán facultados a votar en la elección.     

Cada ALs acreditada tendrá derecho a un voto. Los representantes elegidos serán miembros de varias ALSes, tener su principal lugar de residencia en países de la región, y sus nacionalidades deben ser distintas. Los representantes serán responsables de los deberes estipulados en los Estatutos de ICANN.
En el caso de la elección, la afiliación, residencia y nacionalidad deberán tomarse en cuenta con relación a la persona que actúa como representante vis-Ã -vis el ALAC en nombre de ALAC designado por el NOMCOM.
Por favor notar que las reglas anteriormente señaladas serán interpretadas con lo siguiente:

• Regla 12 – Votaciones
      
      

 12.9 El número de votos emitidos a favor o en contra de alguna moción estará limitado de acuerdo a los siguientes cálculos en cualquier asamblea de naturaleza internacional:

 a)     El número de países o territorios a los que pertenecen todos los miembros de la Asamblea será el numerador.

 b)     El denominador será 100.

 c)     El resultado de la división (a)/(b) se multiplicará por 100.

 d)     Al resultado de 12.9(c) se le referirá como el Porcentaje Máximo.

 e)     Los votos emitidos por los representantes de las ALSs que generalmente estén domiciliadas en un país, no podrán, de manera agregada, exceder el Porcentaje Máximo. Este cálculo se aplicará de manera separada a los votos a favor y en contra de la moción.

• De acuerdo con el Articulo 12.2  y “en conformidad con lo establecido en las Reglas 6.2 y 16, las resoluciones se decidirán por mayoría de las Estructuras de Alcance presentes que voten; para los fines de estas Reglas, la expresión "Estructuras de Alcance presentes que voten" se referirá a las Estructuras de Alcance que emitan un voto afirmativo o negativo. A las Estructuras de Alcance que se abstengan de votar, se les considerará como si no hubieran votado”.

•  El  quorum a ser  considerado, de acuerdo a la Regla 6.1 es “ El quorum sera por mayoria simple de las  ALSes acreditadas referida en la Regla 1.1 y representada en la  Assembly”

• Rule 6 - Quórum

 

6.1 El quórum consistirá en la mayoría simple de las ALSs acreditadas a las que se refiere la Regla 1.1 y que estén presentes y representadas en la Asamblea.

6.2 La Asamblea no podrá tomar decisiones sobre asunto alguno a menos que el quórum requerido esté presente.

•  Procedimiento en caso de EMPATE

La decisión será hecha por sorteo. Sorteo significa la decisión será tomada de manera por selección al azar.

Reglas :

En ausencia de regulaciones acerca de empates en las dos regulaciones de LACRALO disponibles, el documento de LACRALO  AL/2007/SD/2.Rev2, específicamente establece “Las Reglas de Procedimiento de la Asamblea General de la ONU puede ser invocada por participantes en cualquier reunión, o por el Presidente de cualquier reunión, quien puede usar estas Reglas Ordinarias, si se necesitan, para permitir la facilitación de situaciones complejas o difíciles dentro de un marco basado en reglas”

• Regla de  UNA GA 132 [93]  Cuando  se trate de elegir una sola persona o un solo Miembro, si ningún candidato      obtiene en la primera votación la mayoría requerida, se procederá a una segunda votación limitada a los dos candidatos que hayan obtenido mayor      número de votos. Si en la segunda votación los votos se dividen por igual      y se requiere una mayoría, el Presidente resolverá el empate por sorteo.

• Reglas para UN solo candidato  (EN EL CASO QUE DICHA SITUACION OCURRA)

"En el caso de una nominación de un solo candidato, la comunidad LACRALO llevara a cabo una encuesta. Si la mayoría (más de 50%) de gente responde a la encuesta y SIN contar abstenciones, indica NO, entonces el proceso de selección para la posición del ALAC será re-iniciada con una llamada para nominaciones. De lo contrario el candidato será nominado”

 

Abstenciones: De acuerdo a la regla 12.2, Las Estructuras de At Large que se abstengan de votar deberán ser consideradas como no habiendo votado. Sin embargo, regla 19 dice  - Cuando un meeting Virtual de la Asamblea se lleva a cabo, las siguientes reglas No se aplicaran 6, 12.3. Aquellos que voten “abstención” serán contados para propósitos de alcanzar quorum. 

Basados en votos pasados el staff ha identificado que la abstención será considerada para propósito de quorum, pero la abstención no será contada para los resultados; en otras palabras, solo contamos los votos para un candidato determinado (s), y el candidato con la mayoría de votos gana.

 

Para declarar los resultados, en el caso de las elecciones para Presidente y Secretario, la práctica pasada deberá seguirse.

a) El cálculo del Co-eficiente del pais  se aplica

b) El voto no es anónimo (para elecciones de Presidente y Secretario - basado en precedente de  anteriores elecciones)
