ICANN Grants Data Retention Waiver to GANDI SAS

GANDI SAS

GANDI SAS ("Registrar") submitted to ICANN a Registrar Data Retention Waiver Request ("Waiver Request") pursuant to Section 3 of the Data Retention Specification of the 2013 RAA, which provides that if a registrar is subject to the same applicable law that gave rise to ICANN's request to grant a previous data retention waiver under the 2013 RAA, a registrar may request that ICANN grant a similar waiver, which request shall be approved by ICANN, unless ICANN provides Registrar with a reasonable justification for not approving such request.

Registrar's Waiver Request cites the previous data retention waivers granted by ICANN to OVH SAS and MAILCLUB SAS, on the basis of its contention that compliance with the data collection and/or retention requirements of the Data Retention Specification in the 2013 RAA violates applicable law in France.

Registrar, OVH SAS, and MAILCLUB SAS are all Société par actions simplifiée domiciled in France and subject to French law, and ICANN has determined that it is appropriate to grant Registrar a data retention waiver similar to the waivers previously granted to OVH SAS and MAILCLUB SAS.

ICANN hereby grants Registrar a limited waiver from compliance with certain provisions of the 2013 RAA on the following terms:

  1. ICANN agrees that, following Registrar's execution of the 2013 RAA, for purposes of assessing Registrar's compliance with the data retention requirement of Paragraph 1.1 of the Data Retention Specification in the 2013 RAA, the period of "two additional years" in Paragraph 1.1 of the Data Retention Specification will be deemed modified to "one additional year."
  2. In all other respects the terms of the Data Retention Specification will remain AS-IS. The waiver granted to Registrar applies only to the post-sponsorship period of retention of the data listed in the Paragraphs 1.1.1 through 1.1.8 inclusive of the Data Retention Specification, and it does not constitute a waiver of any other provisions of the 2013 RAA or other ICANN policies applicable to registrars. Without limiting the foregoing, nothing in this waiver limits Registrar's obligation to comply with Consensus Policies or Temporary Policies developed and adopted in accordance with ICANN's Bylaws ("ICANN Policies") or limits Registrar's obligation to comply with any amendment, supplement or modification of the 2013 RAA approved and adopted in accordance with the terms of the 2013 RAA ("RAA Amendments"). In the event of any inconsistency between this waiver and the terms of any ICANN Policy or RAA Amendment, the terms of the ICANN Policy or RAA Amendment will control.
  3. The waiver granted to Registrar shall remain in effect for the duration of the term of the 2013 RAA signed by Registrar.

ICANN notes that the provisions of Section 3 of the Specification will apply to similar waivers requested by other registrars that are located in France and subject to French law.

ICANN hereby grants Registrar a limited waiver from compliance with certain provisions of the 2013 RAA on the following terms:

  1. ICANN agrees as follows:

(a) The Registrar shall remain obliged to retain all data elements specified in Articles 1.1.1 through 1.1.8 of the Specification for the duration of its sponsorship of the Registration and for a period of two (2) additional years thereafter; however, Registrar will be permitted to block the data elements specified in Articles 1.1.1 through 1.1.8 of the Specification in accordance with blocking requirements under applicable law (see Sec. 35 para. 3 German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG) at the earliest after one year following the end of the Registrar's sponsorship of the Registration, provided that the rights of data subjects under Sec. 35 para 2 second sentence BDSG shall remain unaffected.

(b) Registrar may exclude from the data retention obligation in the Specification any data elements specified in Articles 1.2.2 and 1.2.3 of the Specification which constitute usage data in the meaning of Sec. 13 para. 4 no. 2 German Telemedia Act (Telemediengesetz – TMG), unless those data are subject to retention periods prescribed by law or statutes or agreed by contract between Registrar and registrant and retained in accordance with Sec. 13 para. 4 no. 2, sentence 2 TMG.

(c) Registrar may block the data elements specified in Articles 1.2.1, 1.2.2 and 1.2.3 in accordance with blocking requirements under applicable law (see Sec. 35 para. 3 BDSG) at the earliest after one year following the end of the Registrar's sponsorship of the Registration, provided that the rights of data subjects under Sec. 35 para 2 second sentence BDSG shall remain unaffected.

(d) It is acknowledged that a transfer of any retained blocked data elements without consent of the data subject is permissible, if the requirements of the exception in Sec. 35 para. 8 BDSG are met.

  1. In all other respects the terms of the Specification will remain AS IS. The waiver granted to Registrar applies only to the post-sponsorship period of retention of the data listed in Articles 1.1.1 through 1.1.8 and Articles 1.2.1 through 1.2.3 inclusive of the Specification, and it does not constitute a waiver of any other provisions of the 2013 RAA or other ICANN policies applicable to registrars. Reminder: Monthly GNSO WG Newcomer Open House Session

These ongoing monthly sessions are for new GNSO WG participants to come together and discuss any questions they may have about GNSO Working Groups, procedures and/or processes. We know there is a lot of information to digest when you join a GNSO Working Group and these monthly meetings are an opportunity for newcomers and more experienced participants to meet in an informal setting without the pressure of “real work” that needs be done.

The agenda is flexible. The presenters will be ready with a standard set of materials if people would like to discuss them.  Feel free to submit questions, either in advance or at the beginning of the meeting, if there is a topic that you would like to explore in more depth .  Providing useful answers to a wide range of questions is part of the reason why these meetings are

GNSO Review Supplementary 360 Assessment!

Participate in the GNSO Review Supplementary 360 Assessment!

To provide further input on the GNSO, a Supplementary 360 Assessment has been launched! This Supplementary Assessment will provide survey takers with a mechanism to give valuable input into the GNSO's Working Groups. The GNSO Working Groups are one of the cornerstones of the ICANN Policy Development process, proving input on them is vital to a successful review.

The Generic Names Supporting Organization (GNSO) serves an important function – it is responsible for developing and recommending to the ICANN Board substantive policies relating to generic top-level domains.

The GNSO Review is part of ICANN's commitment to continuous improvement, accountability and transparency. It uses mechanisms and measures to maintain public confidence in the viability, reliability and accountability of ICANN.

ICANN's Bylaws1 require that its structures, including the GNSO, be reviewed on a five-year cycle. The purpose of the review is to evaluate organizational effectiveness of the GNSO, acknowledge areas that are working well, identify areas that need improvement and affect needed changes.

The quality, validity and acceptance of the GNSO Review and the resulting improvements depend on relevant and useful feedback from a diverse and representative group of people. This is the cornerstone of ICANN's bottom-up multistakeholder model.

The 360 Supplementary Assessment, a new component within the organizational reviews, is designed to gather data for an independent examiner, Westlake Governance, to use in the review process and may also inform GNSO self-improvement efforts.

The 360 Supplementary Assessment is an easy-to-use online tool for the GNSO community, other ICANN structures and community members, the Board and staff to provide valuable feedback to the independent examiner regarding Working Groups.

Results Available for 22 October 2014 New gTLD Auction

22 October 2014

On 22 October 2014, an Auction conducted by ICANN's authorized Auction service provider, Power Auctions LLC, was held to resolve string contention sets for three new generic Top-level Domain (gTLD) strings; SALON, SPOT, and REALTY. String contention occurs when ICANN receives more than one application for the same or a confusingly similar gTLD. The applicants for these strings were unable to resolve the contention sets among themselves, and thus proceeded to an auction, which is the method of last resort to resolve string contention sets as prescribed in Module 4 of the Applicant Guidebook. Subject to payment of the Winning Price and meeting all other criteria for eligibility, the winner will begin the contracting process to sign a Registry Agreement to operate the respective gTLD.

"We continue to see contentions being resolved at a steady pace," said Akram Atallah, President of ICANN's Global Domains Division. "Since last month we have seen 20 contention sets resolved, 3 via ICANN auctions, 1 via Community Priority Evaluation and 16 through self-resolution between applicants."

Four applicants for SALON participated in the Auction. Outer Orchard, LLC prevailed in the Auction with the winning price of $5,100,575.

Three applicants for SPOT participated in the Auction. Amazon EU S.à r.l. prevailed in the Auction with the winning price of $2,200,000.

Two applicants for REALTY participated in the Auction. Fegistry, LLC prevailed in the Auction with the winning price of $5,588,888.

All proceeds from the Auction are being segregated from use until the Board determines a plan for the appropriate use of the funds through consultation with the community. A detailed summary of the Auction proceeds and costs through the September 2014 Auction is available here, and will be updated with the latest information at the end of each month.

Subsequent auctions are scheduled [PDF, 250 KB] to occur on a monthly basis throughout 2014 and into early 2015. The auction events are intended to resolve multiple contention sets simultaneously.

ICANN CEO Congratulates Newly Elected ITU Secretary-General Houlin Zhao

Fadi Chehadé, The President and Chief Executive Officer of the Internet Corporation for Assigned Names and Numbers (ICANN) has extended his congratulations and best wishes to the newly elected Secretary-General of the International Telecommunications Union (ITU).

"We extend our heartfelt congratulations to Houlin Zhao on his election as the ITU Secretary-General," said Chehadé. "His global support was punctuated by the fact that he obtained 152 votes of the 156 countries that were present and voting in the election."

Zhao will succeed current ITU Secretary-General Dr. Hamadoun Toure in January and Chehadé made a point of underscoring Dr. Toure's contributions to enhancing lines of communication with ICANN.

"We are grateful to Dr. Toure for the bridges he helped build between the ITU and ICANN," said Chehadé. "Our interactions have been built on a foundation of mutual respect and a shared belief that the Internet has an increasingly important role in global socioeconomic development. We are enthused at the prospect of continuing those efforts with Houlin Zhao."

Olga Madruga-Forti Resigns from ICANN Board

15 October 2014

Olga Madruga-Forti has announced that she is resigning from the ICANN Board of Directors after serving in that position for two years.

"I have truly enjoyed working with Olga over the years," said ICANN Board Chair Dr. Stephen D. Crocker. "We wish her the best in her new pursuits."

Madruga-Forti's term as an ICANN Director began in October 2012 after she was selected by the Nominating Committee to serve a term that would run through the Annual General Meeting in 2015. As an ICANN Nominating Committee appointee to the ICANN Board her replacement for the remainder of the term will be selected by that committee.

Summary of Public Experts Group Meeting October 14, 2014

On October 14, 2014, the Public Experts Group (PEG) met to discuss evaluation criteria for the selection of Advisors to the Cross Community Working Group (CCWG) in the ICANN Accountability Process. The PEG members, Jeanette Hoffman, Janis Karklins, Larry Strickling and Brian Cute, discussed and agreed to the areas of expertise and evaluation criteria they would use in the selection process. The PEG agreed it was important to ensure that certain areas of expertise are brought into the work of the CCWG and that it should focus on areas of expertise that complement expertise brought by the Community participants in the CCWG.

As such, the PEG identified the following areas of expertise:

 

Board Governance and Corporate Management (for example operational, finance, risk management)

Global Accountability and Transparency – theoretical, practical, tools and metrics

Global Ethics Frameworks and Human Rights (for example consumer protection)

Governmental Engagement and Relations and Multistakeholder Governance

International Law/ Jurisprudence (for example choice of law)

 

A broader list of areas of expertise had been made available to the PEG for consideration. There were certain areas of expertise that are readily available in the ICANN Community (for example, Internet Technical Operations). The PEG believes that it need not duplicate expertise such as this through the appointment of Advisors. After agreeing to these areas of expertise, the PEG began to review the list of candidates presented to conduct and initial screening. We note that some candidates were put forward or are well-connected to existing ICANN Community structures. Since the Advisors will play a purely advisory role in the process, and whereas these candidates may be able to participate more fully in the CCWG, the PEG recommends that these candidates avail themselves of the Community-based mechanism for participation in the CCWG.

The PEG will also consider the need for diversity (for example, geographic, gender) in the Advisors when evaluating candidates. The PEG will review the biographic materials presented by candidates and will conduct its own research as well. The PEG anticipates that it will complete its work by the end of October.
