Documents/Materials: Updated Table with Proposed Final Updates/Refinements to Charter Questions + Suggestions on Data Collection

Action Items:

  1. Changes to the table in the Google Doc
    1. Staff to repurpose the Comments/Discussion column - populate it with contextual information already gathered to provide reference on changes made to the Charter questions, enabling a clear and comprehensive explanation of Sub Team deliverable to the broader Working Group (including the original Charter question 16)
    2. Staff to insert previous notes already collected in the column for data collection
    3. Staff to merge updated question 12 with updated question 11, and incorporate new wording provided by Susan Payne - to be reviewed by the Sub Team, then flagged to the broader Working Group for further follow-up
  2. Staff and Sub Team to follow up on pending actions items from previous week:
    1. Staff to find and circulate earlier answers to the SMD issue provided by Deloitte (in CPH and previously in writing)
    2. Sub Team to discuss/develop definitions on premium names, reserved names, premium Sunrise pricing on mailing list
    3. Staff to match and integrate original and reworded questions with data and timeline discussion
    4. Coordinate discussion on Reserved Names with SubPro (esp WT2) - action for meeting between WG, Sub Team and Work Track chairs (and liaisons)

Notes:

  • Original Charter questions 13 (updated question 11) and original Charter question 22 (updated question 12) should address limitation of scope of use of the RPMs associated with the TMCH to TLDs that are related to the categories of goods and service in which the dictionary term(s) with a trademark are protected
  • If the original Charter question 13 (updated question 11) is already included in the TMCH review, would it be redundant to discuss on this Sub Team, or should it also be discussed in the context of Sunrise? 
  • From AC Chat: Maybe park this for now and suggest that the WG look at all parked questions when they are done with the other questions? 
  • If the WG determines that limitation of inclusion in the TMCH should not be limited to those related to categories of goods and services, a follow-up question on further restrictions during Sunrise may be applicable, and may need to be addressed by this Sub Team
  • From the AC Chat: SUGGESTION - make a notation where the question is being covered in the general or TMCH discussion, and consider refining the question to make it specific to Sunrise. Then the WG can decide whether to take it up as part of a Sunrise review, defer it till the end of Sunrise review, or park it until general TMCH/other relevant discussions have concluded.
  • Restrictions on categories of goods and services are not applicable to general purpose TLDs in terms of Claims Notice, but may be relevant to Sunrise 
  • Need to create requirements/rules on categories of goods and services, and associated enforcement mechanisms 
  • Need to coordinate action on these questions between Sunrise and Claims 
  • Do any of these questions require additional data to answer 
  • No express statements in the STI and IRT reports that provide rationale for Sunrise registrations, but some included in a previous paper by WIPO
