Statement of the At-Large Advisory Committe on the

Application for New Uniform Domain Name Dispute Resolution Policy (UDRP) Dispute-Resolution Service Provider

 

This is the At-Large Advisory Committee comment on the proposed application for New Uniform Domain Name Dispute Resolution Policy (UDRP) Dispute-Resolution Service Provider, filed by the Canada International Dispute Resolution Centre (CIIDRC), published by ICANN on Nov. 16, 2018. We welcome the opportunity to comment on this policy document and strongly support the proposal for a new UDRP Dispute Resolution Provider, viewing it beneficial to the interests of all Internet users, particularily to domain name registrants.

The Canada International Dispute Resolution Centre (CIIDRC) proposal offers a welcome, new opportunity for users to utilize the UDRP amicable dispute resolution procedures. As per WIPO data, the need for domain name disputes arbitration has been on the rise and this is likely to remain the trend with new gTLDs about to be introduced onto the market. Over time arbitration has proven to be more cost and time effective than litigation. With this in mind enriching the pool of service providers is always beneficial to the interest of the users. Introducing a new service provider is also indirectly beneficial to building consumer trust as it results in offering trademark holders and registrants yet another opportunity for professional dispute resolution forum. It therefore ensures end-users that registration and the use of a domain name are indeed carried out by the rightful party.

The proposal meets the formal requirement of ICANN procedures regarding the application process for new service providers. The proposed price range for the new service is within contemporary, customary limits and comparable to those set by similar bodies. Also, the CIIDRC, being a part of the British Columbia International Commercial Arbitration Centre (BCICAC), who has been offering arbitration for the dot.ca ccTLD since 2002, can be expected to offer good quality of services and provide sufficient, high level of expertise. 

In light of all of the above, the At-Large Advisory Committee and the community it represents strongly support the proposed application.
