Affirmation of Commitment Reviews

The Affirmation of Commitment (AoC) (published September 30th 2009) between the US Department of Commerce and ICANN calls for a periodic review of the key AoC objectives:

1. Ensuring accountability, transparency and the interests of global Internet users;
2. Preserving security, stability and resiliency of the DNS;
3. Promoting competition, consumer trust and consumer choice;
4. Whois policy.

The first review will be on accountability and transparency (A&T). It is expected to start in April 2010 and the AoC requires that this review be concluded no later than December 31, 2010. A Call for Applicants for membership in this review team was issued on January 13, 2010 with an update on February 19, 2010 extending the deadline for applications to March 7, 2010 at 23:59 UTC.

Public Consultation on Draft AoC Review Implementation Process

On December 26, 2009, ICANN opened a public consultation on the Draft Proposal for Affirmation Reviews Requirements and Implementation processes. The document proposes a methodology, a mechanism to select the members of the review teams and a timeline for the first review.

On January 21, 2010, the At-Large Advisory Committee submitted a Statement to the public consultation process on the AoC Reviews.

A summary of comments received was issued on February 17, 2010.

AoC Review Teams

According to the AoC, the A&T review team will include the following (or their designated nominees):

  • the Chair of the GAC
  • the Chair of the Board of ICANN
  • the Assistant Secretary for Communications and Information of the DOC
  • representatives of the relevant ICANN Advisory Committees (AC) and Supporting Organizations (SO) and independent experts.

The draft review proposal calls for one representative of the ALAC. The comments received on the draft proposal included many requests for a larger review team allowing for additional representatives from various ACs and SOs. Applicants for the review team positions must be endorsed by the AC or SO that they wish to represent. The ALAC is in the process of designing the procedure under which it will endorse such candidates.

According to the AoC, selection of the A&T review team members will be made jointly by the Chair of the GAC (in consultation with GAC members) and the Chair of the Board of ICANN.

ALAC process for AoC Review Team Member Selection

The following criteria/process presume that the draft process will be ratified by the ALAC at its February 23, 2010 meeting.

RALOs have been asked to identify potential good candidates. There is no requirement that formal RALO support be required for ALAC endorsement.

Interested candidates should forward their applications to the address specified within the formal application instructions. Copies should also be forward to the Chair of the ALAC (Cheryl Langdon-Orr <langdonorr@gmail.com>) and to any applicable RALOs.

In addition to the ICANN-wide requirements, those seeking the endorsement of ALAC must also include a statement of why they believe:

  • they are in a position to fairly access ICANN’s accountability, transparency and the focus on the interests of global Internet users;
  • they will be able to do this from the perspective of the global ICANN At-Large Community and the ALAC.
