Decision by the gTLD RG (8 February 2013)

 

The new gTLD Review Group (gTLD RG)  wishes to thank everyone for the comments received. 

Members of the gTLD RG considered the comments from the At-Large community as of February 8 2013 and ranked each factor of the four tests for community objection grounds based on these comments and discussions. 

Based on the these rankings, there will be no drafting of an objection statement on community grounds for the application for .amazon given that the "detriment" test for community objection grounds was not passed.

      As a citizen of a Latin America country, I would like to stress my concerns regarding the application “.AMAZON” made by Amazon EU S.à r.l., a private company, and I would appreciate if At-Large took this comment into consideration.

      The Amazon is a region that encompasses a large part of the territory of several countries of South America (Bolivia, Brazil, Colombia, Ecuador, Guyana, Peru, Suriname and Venezuela) and it is well known by its biodiversity. The name amazon identifies this geographical region, as well as the largest river of the world, located also in the region.

      The ecological importance of Amazon and the fact that it is a geographical region with its own people, communities and culture should prevent a private company from using this name as it is proposed. This string should be only used to the development, promotion and protection of this region and by its people.

        Leaving aside the issue of what is deemed to be "substantial opposition"* under the 2nd limb of the Community Objection grounds, I have the following to ask:-

        Limb #3: Targeting - Is there not a strong association between .amazon and Amazon customers around the world? Does and should the association with the South American region of Amazon prevail over the association Amazon customers have with the Applicant?

        Limb #4: Detriment - Can anyone point me to an existing (or impending) effort(s) by any entity / person aimed at developing, promoting and protecting the Amazon region? If yes, why have we not had any objections from such entity / person? 

        * I am reading the minutes of the 21.1.2013 New gTLD RG conference call - there were various government objections to .amazon?

        **Just as a side observation - if the Applicant were to be successful in gaining the .amazon string, an interested party should immediately approach the Applicant to sponsor a CSR programme aimed at developing, promoting and protecting the Amazon region.

          GAC advice was issued on this application by the governments of Brazil and Peru.

          The advice said:

          "It should also be noted that the application for the “.AMAZON” gTLD has not received support from the governments of the countries in which the Amazon region is located. Therefore, the Governments of Brazil and Peru (GAC Members), with full endorsement of Bolivia, Ecuador and Guyana (Amazonic nonGAC members) and also of the Government of Argentina would like to request that the “.AMAZON” gTLD application be included in the GAC early warning process."

            Thanks for the update, Dev. So the logical next question would be do gTLD applications which have received GAC early warning 'tags' still fall within the scope of the new gTLD RG or are they to be dealt with by some other committee in ICANN?

          Re Justine's comment on Targeting.  There is undoubtedly a strong association between amazon.com and the company of that name, however, as far as I can see, there is no evidence of such a relationship between .amazon and the company.  As owner of amazon.com, the company is fully capable of establishing as many sub-domains as it would like, eg books.amazon.com, that would maintain the existing identification with the bookseller.

    Researching the community criteria of the community objection grounds ("The objector must prove that the community expressing opposition can be regarded as a clearly delineated community"), I discovered this regional organisation called the Amazon Cooperation Treaty Organization (ACTO). According to the website at

    The Amazon Cooperation Treaty (ACT) was signed on 3 July 1978 by Bolivia, Brazil, Colombia, Ecuador, Guyana, Peru, Suriname and Venezuela, aimed at promoting joint actions towards the harmonious development of the Amazon Basin.

    By that time, ACTO Member States undertook the shared commitment with environmental preservation and the rational use of the Amazonian natural resources.

    In 1995, the eight nations decided to create the ACTO, to strengthen and implement the Treaty goals. The amendment to the ACT was approved three years later, and the Permanent Secretariat was established in Brasilia in December 2002.
