Bernard turcotte - ICANN: (11:58) Sebastien is on a mobile in a train station at the moment.

Marie Fresch - captioning: (12:00) I have Mr. Bachollet as your main speaker, is that correct?

Bernard turcotte - ICANN: (12:01) we will be starting in about 3 minutes

  Alberto Soto: (12:01) Hello everyone!

  Yvette Guigneaux: (12:01) yes Marie

Marie Fresch - captioning: (12:01) Thank you

Yvette Guigneaux: (12:02) the person you just heard now is Bernard Turcotte

Marie Fresch - captioning: (12:02) Thank you

Farzaneh Badiei: (12:12) independence of ombuds employment won't be maintained by a fixed term

Farzaneh Badiei: (12:13) It is not one person in many cases

Farzaneh Badiei: (12:13) it's an office and it's external

Cheryl Langdon-Orr (CLO): (12:18) of course we can look forward to wider ICANN Community input on this as well as other Reason

Farzaneh Badiei: (12:19) and the other problem is that the office is internal. external dispute resolution mechanisms bring more neutrality and independence.

  Farzaneh Badiei: (12:21) sure Sebastien

Cheryl Langdon-Orr (CLO): (12:21) yes and so reliable and predictable... look at Ind DR in last new gTLD round

Bernard turcotte - ICANN: (12:24) hand

  Lars Hoffmann: (12:25) +1 Bernie

Farzaneh Badiei: (12:25) no I am not looking at it as the final report. I am commenting on this comment. you asked for comments

Phil Khoury: (12:27) Agreed Farzaneh - an external ombuds is more independent - however rarely used in a 'single' organisation.  Feedback we received led us to think that a robustly separate 'internal' Ombuds was closer to being accepted than an 'external' model.  But of course that is a possibility.  Phil

  Farzaneh Badiei: (12:27) thanks Phil

Klaus Stoll: (12:29) Who is ICANN on Recommendation 11. ICANN.org, the empowered community, both?

Bernard turcotte - ICANN: (12:30) ICANN the Trinity

Bernard turcotte - ICANN: (12:30) (quoting Avri)

Klaus Stoll: (12:32) Thank for the  clarification. We ned to be very clear about this nowadays.

Bernard turcotte - ICANN: (12:33) Time Check - 27 Minutes left in call

Alberto Soto: (12:35) I do not think I can live in isolation from the community. It is the way of knowing the reality of it. He does not do it to make friends, and in his choice this is taken into account.

Farzaneh Badiei: (12:36) yes but I'd like my comments to be considered in this group and be reported to CCWG

Bernard turcotte - ICANN: (12:38) Farzaneh - usual process is that if you do not feel your comments were accomodated in the draft recommendations of the this group - whenever this group completes these - you can always ask for a minority stmt to be included - but we seem to be far from that yet

Cheryl Langdon-Orr (CLO): (12:38) I just don't want us to get caught up in what *may* be minority views at this stage

Farzaneh Badiei: (12:38) Alberto, ombuds does not have to mingle with the community to understand it. where in the world ombuds mingles and makes friends with the potential complainants?

Farzaneh Badiei: (12:38) it's not really minority view

Farzaneh Badiei: (12:39) you are opposed my view cheryl

Farzaneh Badiei: (12:39) who else is in this group? Avri would support

  Farzaneh Badiei: (12:39) (I think)

Klaus Stoll: (12:39) Let's not speculate what people think.

Cheryl Langdon-Orr (CLO): (12:40) or the wider ICANN community

Farzaneh Badiei: (12:40) Avri told me she would support the first iteration of my comment. she might not agree with all I said here but she said that.

Farzaneh Badiei: (12:42) so what I am saying is minority view in this group? no one supports it? if so I will take it to CCWG

Cheryl Langdon-Orr (CLO): (12:43) everything goes there

Bernard turcotte - ICANN: (12:43) Farzaneh - the recommendations from this group can have a minority stmt.

Cheryl Langdon-Orr (CLO): (12:43) we are just glorified pennholders for drafting of early docs

Bernard turcotte - ICANN: (12:43) It happened in SOAC acct

Farzaneh Badiei: (12:44) who is the penholder? who is making the report? can they take my comment into account? I can file a minority statement otherwise

Bernard turcotte - ICANN: (12:46) Farzneh - regardless who holds the pen the draft report has to be approved by this group before it goes to the plenary and if you feel at that point your points have not been properly considered you can certainly bring these up at the plenary when the document comes up for a reading

Farzaneh Badiei: (12:46) so where is the report?

Cheryl Langdon-Orr (CLO): (12:47) trying to get to that Farming

Bernard turcotte - ICANN: (12:47) Farzneh - that is what this group has to develop

Farzaneh Badiei: (12:47) so lets do it :)

Klaus Stoll: (12:47) we are trying to get to that point.

Cheryl Langdon-Orr (CLO): (12:47) Farzi sorry auto correct

Cheryl Langdon-Orr (CLO): (12:48) that is what this group is doing

Cheryl Langdon-Orr (CLO): (12:48) or trying to

Klaus Stoll: (12:49) If any drafting help is needed, I am available to help.

Farzaneh Badiei: (12:49) ok you have a volunteer Seb

Farzaneh Badiei: (12:50) Klaus volunteered :)

Farzaneh Badiei: (12:51) great. lets start drafting our report

Farzaneh Badiei: (12:52) I wish I had more time to help

Lars Hoffmann: (12:52) @cheryl - you hit the nail on the head.

  Bernard turcotte - ICANN: (12:52) +1 cheryl

Klaus Stoll: (12:52) We are all busy so we need to make choices where we put our energies.

Farzaneh Badiei: (12:52) I am not disputing any of what Cheryl is saying. lets just get drafting our report

Alberto Soto: (12:53) I agree Cheryl

Bernard turcotte - ICANN: (12:53) 7 minutes to top of the hour

Alberto Soto: (12:55) No problem, Sebastien

  Alberto Soto: (12:57) Bay!!!!

Bernard turcotte - ICANN: (12:57) bye all

  Farzaneh Badiei: (12:57) bye
