Summary of RALO advice received

The RALO's advice to the ALAC were in the form of answers to the 5 questions with the possible answers of either

  • Yes, support the filing of the objection statement by the ALAC against applicant,
  • No, NOT support the filing of the objection statement by the ALAC against applicant OR
  • Abstain

Objection statements NOT supported by at least three RALOs will not be considered by the ALAC. For those objection statements that are supported by three or more RALOs, the ALAC will decide whether to file such objection statements to the Dispute Resolution Service Provider (DRSP) before the end of the objection period on March 13, 2013.

As the objection statement against applicant "Stable Tone Limited" for the "健康" string failed to get RALO support, this statement will not be considered by the ALAC.

After consultation with AFRALO members, almost all the ALS
representatives voted
YES to an ALAC objection statement to each of the 4 applications on .HEALTH and
NO to an ALAC objection statement to the IDN application on .HEALTHY

Therefore, these are the decisions of AFRALO.

YES, supports the filing of the objection statement by the ALAC 
    against applicant "Stable Tone Limited" for the ".健康" string   - but  only if

the company voluntarily  submits Public Interest Commitment (PIC) specifications 
    to ICANN for inclusion in its new gTLD registry agreement that display an 
    intent to be socially responsible and carry them out to address the weaknesses 
    in its application with regard to consumer protection (i.e., clear guidelines for 
    assessing potential harm to consumers and consumer health and the appropriate measures 
    for addressing that harm including consultations with relevant experts/authorities).

In the event that such PIC is not forthcoming from Stable Tone, APRALO will overturn
     its support for “.健康” at the ALAC level when it is time for the ALAC to make a decision.

I just realised that, for number 5, I voted yes.  (the dangers of doing 
    something late at night). 
    It should have been no - no objection - but on the conditions suggested.  
    The email I just send explains why - that we first need assurance about the 
    confusion caused by the application.  If that confusion can be addressed by the 
    applicant, we would vote no.  If that issue cannot be addressed we would abstain.

    situation is not much clearer on such a complex issue and we are far from 
    having a "community based position". Under the given circumstances and as 
    indicated before, EURALO *abstains* on the support of the five objections.

    Please note there has been significant debate and disagreement about these
objections within NARALO and it has been difficult to come to a true
consensus. 
	
Based on a brief poll and review of comments received throughout the last 48
hours NARALO advises to NOT promote the objection on the IDN string applied
for by Stable Tone Limited - with 1 YES, 4 NO and 1 abstention.

On the other four Latin/English HEALTH applications NARALO also advises to
NOT promote the objections - with 2 YES, 3 NO and 1 abstention.

This was by no means a clear decisions and there are deep divides within the
region on this issue.
