Memorando de entendimiento firmado en Buenos Aires, el de de 2015

El Registro de Direcciones de Internet para América Latina y Caribe, es una organización no gubernamental internacional establecida en Uruguay en el año 2002. Es responsable de la asignación y administración de los recursos de numeración de Internet (IPv4, IPv6), Números Autónomos y Resolución Inversa, entre otros recursos para la región de América Latina y el Caribe. En adelante denominada “LACNIC”

La Organización At-large para la Región América Latina y el Caribe, en lo sucesivo LACRALO, que comprende a las comunidades de usuarios de individuales de Internet en la región, que se han comprometido a participar a través de la comunidad At Large en el trabajo de desarrollo de políticas de ICANN, en adelante denominado "LACRALO”
CONSIDERANDO:
Que LACRALO tiene entre sus funciones y objetivos:
I. Informar a los usuarios individuales de Internet en la región de América Latina y el Caribe acerca de noticias, reuniones, actividades de desarrollo de políticas y las oportunidades para participación en ICANN;
II. a promover actividades para mejorar el alcance de información a la comunidad de usuarios individuales de Internet en la región de América Latina y el Caribe con el fin de avanzar en el entendimiento y participación en aquellos temas de la agenda de ICANN y que tienen impacto para los usuarios individuales de Internet;
III. Ofrecer mecanismos basados en Internet que permitan la discusión entre los miembros de las ALS de la región con aquellos actores involucrados en el proceso de toma de decisiones de ICANN, así como incentivar a los individuos interesados a compartir sus puntos de vista sobre los asuntos pendientes que trata ICANN;
Que LACNIC tiene entre sus funciones y objetivos:
I. Administrar el espacio de direcciones IP y otros recursos asociados en beneficio de la comunidad Internet para la región de América Latina y el Caribe (LAC).
II. Proveer servicios de registro de direcciones IP, ASN, resolución inversa y sus recursos asociados, con el propósito de permitir y facilitar las comunicaciones a través de redes informáticas.
III. Representar y promover los puntos de vista e intereses de la región ante aquellos organismos internacionales, en el área de su competencia.
IV. Colaborar en el crecimiento de Internet en la región.
V. Asistir a la comunidad latinoamericana y caribeña en el desarrollo de procedimientos, mecanismos y estándares para la asignación eficiente de recursos de Internet.
VI. Promover oportunidades educacionales a sus miembros en áreas técnicas y políticas de su competencia.
VII. Proponer y desarrollar las políticas públicas en el área de su competencia.
Por lo tanto LACNIC y LACRALO acuerdan:
1. LACRALO se compromete a la construcción de una participación significativa de sus miembros a través del compromiso directo con LACNIC;
2. LACNIC se compromete a facilitar el intercambio de información y organizar la educación en colaboración con LACRALO de acuerdo con su visión;
3. Intercambio de información - Las Partes acuerdan intercambiar información para permitir la investigación y el desarrollo a los efectos de facilitar el desarrollo de la Región.
3. Investigación – Cuando fuere necesario, las Partes podrán acordar encarar la investigación conjunta en áreas prioritarias de interés mutuo.
4. Asistencia a Reuniones - Las Partes están invitadas a asistir a las respectivas Reuniones Abiertas a su propio costo, excepto cuando estén disponibles becas y puedan ser ofrecidas por cualquiera de las Partes para facilitar la asistencia.
5. Capacitación - Las Partes se esforzarán cada año para identificar las áreas de formación y para compartir los costos y los recursos que van a facilitar conjuntamente o permitan a sus miembros para beneficiarse mutuamente.
6. Sensibilización y Difusión - Las Partes acuerdan alentar y facilitar la sensibilización y divulgación entre sus miembros para facilitar el crecimiento de la otra parte y el alcance a nuevos países y territorios que son desatendidos.
7. Capacitación y Desarrollo - Las Partes colaborarán para facilitar actividades conjuntas de creación de capacidades en el ámbito de la participación en políticas de dominios de nivel superior y otros temas de interés conjunto.
8. Nombramiento de Comité Técnico – Las partes formarán un comité técnico con dos representantes cada una. En el caso de LACRALO los representantes serán electos anualmente por la comunidad, de acuerdo con la convocatoria y ajuste a las normas que la comunidad adopte para los fines de este convenio. El comité Técnico tendrá como funciones:
a. Establecer anualmente, o por necesidad temporal, las acciones específicas que se realicen conjuntamente, indicando en ellas: Objetivo, Participantes, Recursos y Mecanismos de informes, Transparencia y Rendición de Cuentas.
b. Revisar los informes de actividades y emitir una opinión razonada sonre ellos, que permita decidir sobre acciones futuras.
c. Las que surjan de este convenio de acuerdo entre partes, y no estén amparadas por normatividad superior
9. En caso de que las actividades conjuntas den lugar a la producción de propiedad intelectual nueva, las partes acordarán los términos de su gestión.
Este memorando de entendimiento ha sido debidamente sellado y ejecutado a partir de la fecha arriba indicada.

La Organización Regional At-Large de América Latina e Islas del Caribe, compuesta por las comunidades regionales de los usuarios individuales de Internet, comprometida a participar a través de la comunidad At-Large en el trabajo de desarrollo de políticas de la ICANN, en lo sucesivo denominada "LACRALO".
CONSIDERANDO QUE:
I. LACRALO y LACNIC reconocen los beneficios del apoyo mutuo entre las Partes en el área de desarrollo de políticas de los recursos numéricos de Internet.
II. LACRALO y LACNIC anticipan que cada Parte se beneficiará a partir de las habilidades, el conocimiento y la experiencia complementarias de la otra Parte, en sus roles respectivos.
III. Nada en este Acuerdo se interpretará como legalmente vinculante y exigible en cualquier tribunal de justicia;
IV. LACRALO y LACNIC, a las cuales en el presente acuerdo se hace referencia como las "Partes", acuerdan lo siguiente:
1. Promover el desarrollo de infraestructura y de negocios en la región y la industria. Las Partes acuerdan cooperar para promover estándares de Internet, desarrollo de infraestructura y servicios con el fin de fomentar el desarrollo de Internet en la región de América Latina y el Caribe.
2. Cooperar y mantener un canal de comunicación abierto para el desarrollo y beneficio mutuos de ambas organizaciones.
3. Potencialmente facilitar eventos conjuntos de desarrollo de capacidades y, ocasionalmente, actividades relacionadas de interés mutuo, entre ellas: reuniones, formación, proyectos, talleres, así como la investigación y el desarrollo en materia de políticas de los recursos numéricos de Internet y operaciones de registro.
4. Trabajar para crear la participación regional a través de posibles programas de difusión conjunta y de becas sobre asuntos relacionados con el desarrollo de políticas de los recursos numéricos de Internet.
Este Memorando de Entendimiento ha sido debidamente sellado y formalizado a partir de la fecha arriba indicada.

BETWEEN
The Latin American and Caribbean Internet Addresses Registry, an international nongovernmental organization established in Uruguay in 2002 responsible for the allocation and management of Internet number resources (IPv4, IPv6), autonomous numbers and inverse resolution, among other resources for the Latin American and Caribbean region, hereinafter referred to as "LACNIC",
AND
The Latin American and Caribbean Islands Regional At-Large Organization, comprising the regional communities of Internet individual users committed to participate through the At-Large community in ICANN policy development work, hereinafter referred to as "LACRALO".
WHEREAS:
LACRALO's functions and objectives include:
I. To inform individual Internet users of the Latin America and the Caribbean region about news, meetings, policy development activities, and opportunities to participate in ICANN.
II. To promote activities intended to improve outreach to the community of individual users in the Latin America and the Caribbean region in order to advance understanding and participation in those ICANN agenda items that have an impact on individual Internet users.
III. To offer Internet-based mechanisms to enable discussions between members of the regional ALSes and the stakeholders involved in ICANN decision-making process, as well as to encourage stakeholders to share their views about ICANN pending issues.
LACNIC's functions and objectives include:
I. To manage the IP address space and other related resources for the benefit of the Internet community in the Latin America and the Caribbean (LAC) region.
II. To provide IP address registration, ASN, and inverse resolution services and their related resources, in order to enable and facilitate communication through computer networks.
III. To represent and promote the views and interests of the region before international agencies, within its area of competence.
IV. To collaborate in the regional growth of Internet.
V. To assist the Latin America and Caribbean community in the development of procedures, mechanisms and standards for the efficient allocation of Internet resources.
VI. To promote educational opportunities for its members in technical areas and policies within its area of competence.
VII. To propose and develop public policies within its area of competence.
Therefore, LACNIC and LACRALO agree to the following:
1. LACRALO commits to build meaningful participation of its members through direct engagement with LACNIC.
2. LACNIC commits to facilitate the sharing of information and organize education in collaboration with LACRALO in accordance with its vision.
3. Sharing of Information - The Parties agree to share information to enable research and development for the purposes of facilitating development in the region.
3. Research - From time to time, the Parties may agree to commission joint research in priority areas of mutual interest.
4. Meeting Attendance - The Parties are welcome to attend each other’s Open Meetings at their own cost except where fellowships may have been offered by either Party to facilitate attendance.
5. Training - The Parties shall endeavor to each year identify areas of training and to share costs and resources that they will jointly facilitate or enable their members to mutually benefit.
6. Awareness and Outreach - The Parties agree to encourage and facilitate awareness and outreach amongst its members to facilitate growth of the other party and outreach into new countries and territories that are underserved.
7. Capacity Building - The Parties shall collaborate to facilitate joint capacity building events in the area of policy engagement where top level domains and other topics of mutual interest are concerned.
8. Appointment of a Technical Committee – The Parties shall create a technical committee with two representatives each. In the case of LACRALO, the representatives shall be elected annually by the community, according to the call and following the rules adopted by the community for the purpose of this agreement. The Technical Committee shall have the following functions:
a. To establish annually, or as needed, the specific actions to be carried out jointly, indicating in each case: Objective, Participants, Reporting Resources and Mechanisms, Transparency, and Accountability.
b. To review the activity reports and issue a reasoned opinion about them for future decision-making.
c. Those functions arising out of the present agreement that are not covered in higher regulations.
9. In case joint activities produce new intellectual property, the Parties shall agree on the terms of their management.
This Memorandum of Understanding has been duly sealed and executed as of the date above.

WHEREAS:
I. LACRALO and LACNIC recognise the benefits of mutual support between the Parties in the area of Internet number resource policy development.
II. LACRALO and LACNIC anticipate that each Party will benefit from the complementary skills, knowledge and experience of the other Party in their respective roles.
III. Nothing in this Agreement shall be construed to be legally binding and enforceable in any court of law;
IV. The LACRALO and LACNIC, referred to in this agreement as the “Parties”, agree to the following:
1. To promote infrastructure development and business in the region and industry. The Parties agree to cooperate to promote internet standards, infrastructure development and services in order to encourage internet development in the Latin America and Caribbean region.
2. To cooperate and maintain an open communication channel for the mutual development and benefit of both organisations.
3. To potentially facilitate joint capacity building events and related activities of mutual interest from time to time including meetings, training, projects, workshops and research and development related to Internet number resource policy and registry operations.
4. To work to create regional participation through potential joint outreach and fellowship programmes on matters relating to Internet number resource policy development.
This MOU has been duly sealed and executed as of the date above.
